The agreement between you and us when you use the platform.

Who you are contracting with

The platform is operated by Almacq Holdings. Using any part of it means you accept these terms. You can reach us at support@almacq.com.

What we do, and what we do not

We provide the software that restaurants use to take orders, run their tills, and dispatch deliveries. We do not cook the food and we do not sell it. Your contract for an order is with the restaurant. They are responsible for the food, its description, its price, and its preparation, including allergen information.

Your account

  • Give accurate details, and keep your phone number and email current, because that is how we verify it is you.
  • Do not share your sign-in code or staff PIN. Activity under your account is treated as yours.
  • You must be old enough to enter a contract where you live.
  • Tell us promptly if you think someone else has access to your account.

Orders, payment, and refunds

Prices and availability are set by the restaurant and can change. Payment is taken through our processor when you place the order. Refunds are decided and issued by the restaurant against the original payment method; we process what they authorise. If a restaurant cannot fulfil an order it has taken payment for, it is required to refund it.

If you run a restaurant on the platform

  • You are responsible for your menu, prices, allergen and food safety information, and for holding the licences your jurisdiction requires.
  • You are responsible for the staff accounts you create and what they do with them.
  • You keep ownership of your menu, customer, and order data. You can export it, and we will return it if you leave.
  • Subscription fees, where a paid plan applies, are billed in advance and are non-refundable for a period already served.
  • We may suspend an account that is being used unlawfully, that is defrauding customers, or that is not paying for a plan it is on.

If you ride for a restaurant

Riders are engaged by the restaurant, not by us. We provide the app used to receive and complete jobs. You are required to hold a valid licence and any insurance the law requires, and to keep the verification documents on your account current.

Acceptable use

  • Do not attempt to access another restaurant, rider, or customer account or their data.
  • Do not probe, scan, or attack the platform, except to report a vulnerability responsibly as described on our support page.
  • Do not use the platform to break the law, or to post content that is unlawful or abusive.
  • Do not scrape the platform or resell access to it.

Availability

We work to keep the platform available and to keep your data safe, but we do not promise it will never be interrupted. Planned maintenance is announced in advance where we can.

Liability

Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. Subject to that, we are not liable for the quality or safety of food, which is the restaurant’s responsibility, nor for indirect or consequential loss.

Ending the agreement

You can close your account at any time: see Delete your account and data. We can end or suspend access if these terms are broken. Provisions that by their nature should survive termination, such as those about payment already owed and liability, do so.

Changes to these terms

We update these terms as the platform changes. If a change materially affects what you are agreeing to — how payment works, what we may do with your data, what you are liable for — we will tell you in the app before it takes effect, and continuing to use the platform after that is how you accept it. If you would rather not, you can close your account. The date at the top of this page always reflects the current version.

Your privacy

How we handle personal data is set out in our Privacy Policy, which forms part of this agreement. It covers what each app collects, where it is held, how long we keep it, and how to have it deleted.

Governing law and contact

These terms are governed by the laws of Ghana, and the courts of Ghana have jurisdiction over any dispute arising from them. Nothing here removes a right you have under Ghanaian consumer or data protection law that cannot be given up by agreement.
